In re Nuvasive: § 103 “Motivation” to Combine Prior Art Teachings

Today in In re Nuvasive, __ F.3d __ , __ , slip op. at 8-13 (Fed. Cir. 2016)(Wallach, J.), in the process of reversing a PTAB ruling of obviousness under 35 USC § 103, the court provides a tutorial on the law of “motivation” to combine references to show such obviousness.

The opinion is must reading for practitioners (beginning at page 8 as highlight marked in yellow with a red arrow).
