Enfish v. Microsoft: Software Patent-Eligibility under §101

Enfish, LLC v. Microsoft Corp., __ F.3d __ (Fed. Cir. May 12, 2016)(Hughes, J.), is a an important decision dealing with software patent-eligibility, but only because it is a rare case in which the Federal Circuit reached a conclusion of patent-eligibility.

The attached paper puts Enfish in perspective.  The paper includes an extensive quotation of the relevant portions of the Enfish opinion; and,  as an appendix, the May 19, 2016 official guidance on Enfish from the Patent and Trademark Office.
