In Top Ten No. (7) Life Techs. Corp. v. Promega Corp., Supreme Court No. 14-1538, the Solicitor General has now filed his CVSG amicus brief. He recommends that the Court grant the petition for certiorari, but only as to the Second Question Presented:
“Whether the Federal Circuit erred in holding that supplying a single, commodity component of a multi-component invention from the United States is an infringing act under 35 U.S.C. § 271(f)(1), exposing the manufacturer to liability for all worldwide sales.”
The case is expected to be scheduled for Conference in time for a vote whether to grant certiorari in the current Term that runs until the end of June. The case is considered in more detail in the attached Top Ten Patent Cases.
