Warner-Lambert v. Sandoz: U.K. Loser Pays Costs System

Today in Warner-Lambert Company LLC v. Sandoz GmbH, 2017] EWHC 216 (Pat) (High Court 2017)(Arnold, J.), the Court awarded costs against the unsuccessful litigant Sandoz in the amount of £100,000 where the Court had dismissed an application by Sandoz to vary an interim injunction.

The Ordinary Course of Business:  Warner-Lambert v. Sandoz is nothing extraordinary but, instead, the case is brought forward, here, to show a clear difference between American and English practice.
