Wallace v. Ideavillage Products: Wise Use of Judicial Resources?

March 3, 2016| in Wegner's Writings| by Hal Wegner

Today in Wallace v. Ideavillage Products Corp., __ Fed App’x __ (Fed. Cir. 2016)(Newman, J.), in the course of a routine affirmance in a pro se appeal denying infringement of a claimed design for a body washing brush, the court issued an eleven (11) page opinion, which could have been boiled down to a single paragraph.

Proper Use of Scarce Judicial Resources?  To delay proceedings on othercases often worth many, many millions of dollars to take a detour to explain the facts in a body washing brush design case is difficult to comprehend.

Further analysis together with a yellow highlight marked copy of the opinion are attached.
