Top Ten No. (9) MCM Portfolio, Is IPR Unconstitutional?

In Top Ten No. (9) MCM Portfolio v. Hewlett-Packard, opinion below, MCM Portfolio LLC v. Hewlett-Packard Co., __ F.3d __(Fed. Cir. Dec. 2, 2015)(Dyk, J.), patentee questions whether Inter Partes Review is unconstitutional because a patent can be invalidated without a trial by jury.
The petition falls due April 29, 2016.
