Further to the note yesterday, SCA Hygiene v. First Quality Baby has been moved up a notch to Top Ten No. (6a), joined by new Top Ten No. (6b) Medinol Ltd. v. Cordis. It appears possible that certiorari may be granted in either case (or both).
Each case raises an issue of laches; each case has been scheduled for a secondconference, scheduled for April 22, 2016.
If certiorari is granted in either case (or both), merits briefing would take place in the coming months. Argument and decision would occur in the coming October Term that runs through June 2017.
The two cases are considered in the attached Top Ten Patent Cases.
