The grant of certiorari this morning in Top Ten No. (6) SCA Hygiene Prods. Aktiebolag v. First Quality Baby Prods.,LLC, S.Ct. No. 15-927, opinion below, LLC, 807 F.3d 1311 (Fed. Cir. 2015)(en banc), will now lead to a possible decision as to whether Federal Circuit patent laches law is consistent with the Supreme Court copyright laches case, Petrella v. Metro-Goldwyn-Mayer, Inc., 134 S.Ct. 1962 (2014).
Merits briefing will take place in the coming months with argument in the October 2016 Term that runs through the end of June 2017.
