Top Ten No. (4) Cuozzo Speed v. Lee: “Smart Money” on the PTO, per Circuit Judge Plager

In Cuozzo Speed Technologies LLC v. Lee, Supreme Court No. 15‑446, Circuit Judge S. Jay Plager predicts a PTO victory that would sustain his court’s decision in the appellate proceedings below, according to the press report by Jimmy Hoover, Fed. Circ. Judge Foresees PTAB Win In High Court Case, Law360, Washington (June 15, 2016, 6:50 PM ET).

What the “Smart Money” Says:  “Predicting the outcome of a pending case before the Supreme Court, Federal Circuit Judge S. Jay Plager said Wednesday that the ‘smart money’ is on the Patent Trial and Appeal Board maintaining its standard for reading patent claims[.]”  Id.
