This Thursday the Supreme Court is scheduled to vote whether to grant certiorari in both cases; each has a substantial chance for grant:
Top Ten No. (2) Sequenom v. Ariosa Diagnostics (patent-eligibility under § 101) has attracted broad attention.
Top Ten No. (7) Life Techs. v. Promega (whether § 271(f)(1) infringement exists by supplying a single, commodity component of a multi-component invention from the United States) is headed for a SECOND conference. Additionally, an affirmative CVSG recommendation suggests grant of certiorari.
If certiorari is granted in either case, it would be announced at 9:30 AM EDT on Monday, June 27, 2016.
