Top Ten No. (1) Sequenom v. Ariosa: From the standpoint of the law of patent-eligibility under 35 USC §101, this is a most important case. The petition is now due April 1, 2016 (see TOP TEN PATENT CASES, pp. 2-6)(attached).
ePlus, Arthrex Certiorari decisions today? It is unclear whether the Court will issue a decision as to grant of certiorari in either ePlus v. Lawson Software (id., p. 17) or Arthrex v. Smith & Nephew (id., p. 23). Both had been scheduled for the Conference cancelled due to the passing of Justice Scalia but the electronic docket sheet does not show that the cases have been rescheduled for a later Conference.
