Sequenom v. Ariosa: The Expected Petition to the Supreme Court

Within the next two weeks the expected certiorari petition may be filed in the captioned case.  The petition will challenge the Federal Circuit denial of patent-eligibility under 35 USC § 101 on claims to a pioneer method of fetal testing through a simple blood test without amniocentesis.

The Bilski Losing Streak:  If certiorari is granted, this case may represent a best chance to reverse the patent-eligibility losing streak that started in 2010 with Bilski. 

“The Sequenom Certiorari Petition: Whither Patent-Eligibility?”: The captioned paper (attached) provides an analysis of what may be the best way to challenge the Federal Circuit decision.
