Saertex France v. Hexcel Reinforcements: “Free Beer” Claims

May 4, 2016| in Wegner's Writings| by Hal Wegner

Today in Saertex France SAS v. Hexcel Reinforcements UK Ltd., [2016] EWHC 966 (IPEC)(Hacon, J.), as part of an invalidity ruling, the trial judge cites Lord Hoffmann in Lundbeck A/S v Generics (UK) Ltd, [2008] EWCA Civ 311; [2008] R.P.C. 19, at [61], concerning whether the claims are “free beer” claims where the patentee merely claims a desirable end result and thus encompasses all solutions to that result (¶  47).

The attached pdf version of this note includes further details and a yellow highlight marked copy of the opinion.
