In re Efthymiopoulos: Yet Anorther Dissent

October 18, 2016| in Wegner's Writings| by Hal Wegner

Today in In re Efthymiopoulos, __ F.3d __ (Fed. Cir. 2016)(Prost, C.J.), in an otherwise legally unimportant case, the panel affirmed an obviousness rejection of claims to a method of oral inhalation of the drug Zanamirvir,  where the prior art taught the otherwise identical method via nasal inhalation.

World Record for Patent Dissents:  What distinguishes Efthymiopoulos is the dissent by the Great Patent Dissenter who once again breaks her world record for dissents in a patent case. Efthymiopoulos, __ F.3d at __ (Newman, J., dissenting).

Regards,
Hal
