Cuozzo Speed v. Lee: On the Road to Possible Grant of Certiorari

January 12, 2016| in Wegner's Writings| by Hal Wegner

In a case with a better than average chance for grant of certiorari, Top Ten No. (10) Cuozzo Speed Technologies LLC v. Lee, Supreme Court No. 15‑446, petitioner directly challenges the rule for post grant proceedings that claims should be given their “broadest reasonable interpretation”.

Enhanced Likelihood of Grant of Certiorari:  The fact that today the Court didnot act on the certiorari petition (when it was scheduled to do so) means that the case is being given closer scrutiny and may well be granted at the next Conference.

Cuozzo Speed is considered in more detail in Top Ten Patent Cases attached to the pdf version of this note.
