Amphastar, one of the Top Supreme Court Patent Cases (list attached), was scheduled for acertiorari vote at the Conference earlier this week. See Top Case No. (7), Amphastar Pharmaceuticals, Inc., et al. v. Momenta Pharmaceuticals, Inc., et al., No. 15‑1402, which deals with the scope of the § 271(e)(1) “safe harbor” for testing a pharmaceutical for regulatory approval purposes.
Blockbuster Patent Year at the Court: Even without grant of review in Amphastar (or any of the many other cases considered at the same Conference), the new Supreme Court year for patents that starts next week promises to be one of the busiest in recent history.
