Ben Herbert recently transitioned from private practice as an intellectual property litigator into litigation finance by joining Law Finance Group. Mr. Herbert is responsible for Law Finance Group’s operations in Los Angeles, focusing on originating new business across all areas of litigation and underwriting Law Finance Group’s transactions and investments, including those related to intellectual property.
Prior to joining Law Finance Group, Mr. Herbert was a partner in Kirkland & Ellis’ Intellectual Property Litigation Group in Los Angeles. He had significant success representing plaintiffs in trade secret misappropriation trials. Indeed, between 2019 and 2021, he was a key member of three trial teams that secured more than $1.5 billion in jury verdicts in such cases. During his decade at Kirkland & Ellis, Mr. Herbert worked on and led teams litigating complex cases involving diverse technologies, including digital radios, medical devices, computer software and hardware, graphics processors, bitcoin mining, portable power generation, and satellite technology. He also acquired significant experience before the United States Court of Appeals for the Federal Circuit, including arguing before the court.
Mr. Herbert is also a frequent author and speaker on topics related to trade secret misappropriation and patent infringement, having been published in the Daily Journal and Managing Intellectual Property, and speaking at the Sedona Conference and the Intellectual Property Owners Association’s annual conference.
Prior to joining Kirkland & Ellis, Mr. Herbert served as a law clerk to Judge Kathleen O’Malley (ret.) at both the United States District Court for the Northern District of Ohio and the United States Court of Appeals for the Federal Circuit.
