In Top Ten No. (7) Samsung Electronics v. Apple, the Court has scheduled a secondConference for a vote whether to grant certiorari .
Scope of Design Patent: The first Question Presented asks “[w]here a design patent includes unprotected non-ornamental features, should a district court be required to limit that patent to its protected ornamental scope?”
Cert. Decision by Next Monday: The Second Conference is scheduled for this Friday with a decision expected as part of the Orders List on March 21, 2016. The petition has a higher than usual chance for success.
